Terms and Conditions
You
acknowledge that the products or services you have ordered, as
detailed in our quotation and / or your purchase order is subject to these Terms and
Conditions. PAYMENT IN FULL OF THE AGREED PRICE MUST BE PAID IN
FULL ON RECEIPT OF THE JOB. You, the undersigned, warrant that
you have the right to use the images, computer files and video
you have supplied to David Venish T/A Stepthru (hereinafter
referred to as “the publisher) for replication and printing
(hereinafter referred to as “the service”). You further agree
that you will indemnify the publisher against any damages and
costs that may be awarded against the publisher and / or any
expenses incurred by the publisher with respect to any claims or
action that the service infringes the patent, copyright,
registered design, trade mark, trade name, or other intellectual
property rights of a third party or that the services infringe
any other laws or by-laws. In addition you warrant that images,
computer files and video you supply for inclusion in the service
shall not contain unlawful material. These terms and conditions
shall be construed in accordance with the Law of New South Wales
and that any proceeding in respect of any dispute arising out of
these terms and conditions or the service must be commenced in
the Courts of New South Wales. You agree that any allegedly
faulty goods must be returned to the publisher immediately. Any
allegedly faulty goods will be re-supplied by the publisher if
the replication process is at fault. You further agree that the
publisher will not be liable for any special, consequential or
incidental loss or damage or for any indirect loss or damage
including without limitation to the forgoing, exemplary or
punitive damages to property, loss of profits, or damages to
personal property, even if the publisher is informed of the
possibility of such damages. You agree that no joint venture,
partnership, employment, or agency relationship exists between
you and the publisher as a result of this agreement. The
publisher reserves the right to refuse to accept an order. You
agree that the replicated discs and packaging material remain
the property of the publisher until paid for in full.
In the event that the publisher needs to recover
monies owed then all costs incurred by the publisher or its solicitors,
legal advisers, mercantile agents & other parties acting on behalf of the
publisher of recovering this money will be born by the debtor.
